Terms & Conditions

Terms and Conditions for retaining the services of Nina the Greener Cleaner and Friends (hereafter referred to as ‘the Agency’). 


The client acknowledges that the results of any services provided may vary depending on a number of factors (including time elapsed since premises was last cleaned, and nature of cleaning required), and that the Agency gives no all-inclusive guarantee as to the results of the service. This agreement may be modified over time, in negotiation with you, to accommodate changes that may occur in your home, or in the agency.

By booking with us, or by continuing with our service if you are an existing client, you agree to the following terms and conditions:

  1. You authorise the Agency and it’s subcontracted Friends to access and use premises owned or leased by you for the purpose of delivering the service;

  2. You will provide unencumbered and unobstructed access to those areas of the premises requiring the service;

  3. You will ensure that the premises provide a safe work environment for the Friends to clean in;

  4. You will advise Agency prior to the commencement of the service of the presence and location of any hazards, slippery surfaces, risks or dangers at the premises;

  5. You will provide access to all usual services and utilities (including hot and cold water, electricity, and rubbish bins) as may be reasonably required to provide the service;

  6. You will move any large, heavy, or cumbersome items (such as whitegoods, bookshelves, or beds) in preparation for additional cleaning behind, or underneath, such items;

  7. You will secure or remove any fragile, delicate, or breakable objects or any items of great sentimental or financial value prior to the commencement of the service.

Exclusions and limitations

The Agency and Subcontracted Friends are not responsible for:

  1. Failing to complete or provide the service as a result of a breach of a warranty by the client. This includes a failure by the client to provide unencumbered access to the premises; a safe working environment; access to power and utilities; and/or any other materials or services needed to provide the service;

  2. Failing to complete or provide the service due to health and safety concerns at the premises;

  3. Failing to complete or provide the service due to an act or omission by the client at the premises during provision of the service;

  4. Any loss or damage incurred by the client or any third party as a result of the effects of a force majeure, being any event beyond the reasonable control of the Agency or Friend;

  5. Any damage caused by defective cleaning materials, cleaning equipment or practices requested or provided by the client or by cleaning anything under instruction that is not fit for purpose or fit for cleaning.

  6. Any loss incurred as a result of any breakage or damage to goods, items of value (including antiques and items of sentimental value) or to the premises that are not covered under the Friend’s Public Liability insurance coverage.2∗

  7. Any ingrained dirt, grease or grime, wear, damage or stains that cannot be completely cleaned or removed by Friend or representative of the Agency;

  8. Any wear or discolouring of fabric or surfaces which become more visible once dirt or stains have been removed;

  9. The cost of any key or security card replacement or locksmith fees, unless keys or security cards were lost by Friend or representatives of the Agency.

Indemnity

You agree to indemnify and to keep indemnified the Agency, its representatives and Friends against all damages, losses, claims and costs incurred in connection with a demand, action, arbitration, or other proceeding (including mediation, compromise, out of court settlement or appeal), arising directly or indirectly as a result of or in connection with:

  1. A breach of this agreement by the client.

  2. Any injury to, or loss of property of, any person in or on the premises, except to the extent that such injury or loss is contributed to directly or indirectly by any negligent or deliberate wrongful act or omission of the Agency, its subcontractors, agents, contractors or others for whom Nina the Greener Cleaner and Friends is legally responsible;

  3. Any negligent or wilful act or omission of the client, its employees, agents, servants, contractors or others for whom the client is legally responsible;

  4. Any warranty, promise or representation made by the client or any employee, agent, or other person acting on the client’s behalf.
